You do. Every custom module is committed to your Git repository and transferred to you in full, without license restrictions on your store. Documentation and tests are part of the delivery. If you later move development in-house or to another agency, they receive working, documented code they can maintain.
Usually, yes. We first reproduce the problem on staging and check whether the vendor has released a fix. If not, we correct the behavior with a plugin, a preference in a custom module or a Composer patch, leaving the vendor files untouched. We also tell you when replacing the extension is the better option.
